                                ORDINANCE NO. 9714
        
        
        
                   AN ORDINANCE TO DESIGNATE ST. ELMO, MORE
                   PARTICULARLY DESCRIBED ON EXHIBIT A ATTACHED
                   HERETO AND MADE A PART HEREOF BY REFERENCE, AS
                   A LOCAL HISTORIC DISTRICT AND TO ADOPT THE
                   SPECIFIC DESIGN GUIDELINES.

              	   WHEREAS, it has been determined that there is a need
         to preserve and protect the historical, architectural 
character,
         and  cultural heritage of St. Elmo, and
              	   WHEREAS, on MARCH 17, 1992, the Historic Zoning
         Commission by resolution recommended to the City Council of the 

         City of Chattanooga that the St. Elmo district, more
         particularly described herein on Exhibit A attached hereto and
         made a part hereof by reference, be designated as a Local
         Historic District pursuant to the provisions of Tennessee Code
         Annotated A713-7-402, et seq.; and
              	   WHEREAS, the City Council of the City of Chattanooga
         has reviewed the resolution and report of the Chattanooga
         Historic Zoning Commission and concurs in the findings of said
         Commission; and
              	   WHEREAS, the City Council has reviewed the Specific
         Design Guidelines;
        
                                 NOW, THEREFORE,
              	   SECTION 1.	  BE IT ORDAINED BY THE CITY COUNCIL OF
         THE CITY OF CHATTANOOGA, TENNESSEE, That the St. Elmo district
         be and is hereby designated as a  Local Historic Distict, more
         particularly described herein on Exhibit A attached hereto and
         made a part hereof by reference.
              	   SECTION 2.	  BE IT FURTHER ORDAINED, That the
         Specific Design Guidelines, attached hereto and incorporated
         herein by reference, be and are hereby adopted for the Local
         Historic District established herein.
        
              	   SECTION 3.	  BE IT FURTHER ORDAINED, That this
         Ordinance shall take effect two weeks from and after its
         passage, the public welfare requiring it.
